• • Consumer Agreement

  • By accepting these terms and conditions, buyer agrees to all terms and conditions herein.  By accepting any or all of the following: delivery of product, testing kit, email communications regarding your order, email consent forms, professional collection services, test results, etc., buyer indicates validity and authorization of purchase and acceptance of terms.

    PaternityUSA.com performs the sales function of the DNA tests, and DDC performs the laboratory analysis in accordance to AABB guidelines where applicable. Consumer agrees to hold PaternityUSA harmless for ANY lab or specimen collection related issues.  PaternityUSA works tirelessly in effort that all facets of the transaction work together smoothly providing a great buying experience.

    Once results are delivered an additional fee will apply to redeliver results. For information and pricing, please contact our office.

    Testing time frame: all cases will remain open and active for 90 days after order date.  If more time is needed to obtain samples, please email sales@paternityusa.com within that first 90 days and let us know. Cases can be extended to remain active for up to 180 days, or 6 moths from order date. After that time, or if no contact has been made within the first 90 days, the case will be closed due to inactivity and a fee will be required for re-opening the case, or a new case must be ordered depending on the age of the original order.

    With Regard To Legal DNA Tests:
    *Disclaimer: Due to differences among courts and state laws, we cannot absolutely guarantee that a judge will accept the results of a DNA test as qualified evidence. However, the results of our legally binding DNA tests are AABB accredited and notarized as long as chain of custody is complete and in tact when samples arrive in the lab. Legally binding results meet the standards set by courts, legal institutions, and as set forth by accrediting agencies worldwide.  If you are still unsure of the admissibility of any DNA test, we suggest that you ask your attorney to set your mind at ease. (Charges of $35.00-$75.00 per person apply for each being  professionally collected, but may be more if mobile services, weekend or evening appointments are needed.)

    With Regard To All Tests:
    If a DNA test is ordered with multiple participants, and one or more participant decides to opt out of the testing after the order is placed, no refund will be due for the change, and we are unable to go back at a later date and test with that individual(s) if/after testing begins in the case.

    To change your DNA test order after the order has shipped, an order change fee will apply.

• • Shipping & Delivery

  • At this time, PaternityUSA.com ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, PaternityUSA.com ships merchandise to Canada and Mexico.  Please inquire for other international locations. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier. Our overnight delivery option applies only to physical addresses within the contiguous USA except New York. We do not ship informational kits to New York. Everywhere else Int’l shipping charges apply.  We can only ship to Post Office box addresses via first class USPS mail. While we make every effort to have your collection kit to you within the specified time frame, refunds are not due as a result of shipping delays or exceptions.  Next day or 2nd day delivery is not guaranteed.  We offer USPS shipping within contiguous US at no charge.

    Under no circumstances are shipping costs refundable or transferable.

    Additional fees apply to re-ship collection kits that show delivered through their tracking numbers, or where incorrect addresses have been provided on the order, or if samples received are insufficient for testing.

    Neither PaternityUSA and/or laboratory is responsible for DNA samples lost in the mail or undelivered whether samples are in transit to lab or return to client.
    PaternityUSA is not responsible for any undelivered mail or DNA samples either to the client or to the lab.

  • Customs and import duties may be applied to international orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

    Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. PaternityUSA.com is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

In these cases, the extra testing is processed in an expedited manner and therefore no refund for expedited processing is granted. • • Return Policy

  • DNA Test Refund Policy:

    We are happy to try and work with our clients, as we understand life doesn’t always work out like expected.

    You purchased a DNA test because you have questions, and we want to help answer those questions for you.  If you need more time to collect your samples, or need to change a participant, please call our office to find out how to go about changing your case instead of cancelling it.

    All refund inquiries must be submitted via email and cannot be taken over the phone.  If DNA test services are canceled before shipping and/or handling, a $35 refund processing fee and $25 administrative fee per shipment or case scheduled will be deducted.  All shipping costs, including international shipping and second addresses, etc., are non-refundable and will be deducted from any refund amount.

    If a refund request is filed within 3 days of the order date, refunds will be issued according to our policies (see below).  Refunds for DNA or paternity test kits, internet sales or specials, and international orders will not be issued: all sales are final.

    If a DNA test kit has already been shipped, collection and mailing instructions along with a case number provided to you through any means, or a collection appointment has been made on the participant’s or participants’ behalf, a 50% refund (less shipping, if any) will be applied to all unused paternity or DNA test kits and/or services.  The collection kit and unused USPS return envelope have been returned to DDC at buyer’s expense (must be postmarked within 3 days of order and cannot use included return mailer to return kit).

    For “make your own kit” orders, when your order is processed and case set up, we will email your case number, sample collection and mailing instructions. This email constitutes receipt of service/merchandise in lieu of the DNA collection kit.

    Further, missed appointment fees may apply in addition to other costs associated with processing your order if the appointment is not cancelled in an appropriate time / manner. Mobile DNA collection fees and shipping for legal DNA test kits are non-refundable.

    For refunds on an order with a New York shipping address purchased as a non-legal, informational test, despite the notices in shopping cart, no full refund shall apply.  The standard refund as stipulated for refunds before the kit is shipped applies – If DNA test services are canceled before shipping and/or handling, a $35 refund processing fee and $25 administrative fee per order will be deducted.

    If samples you send in are received and processed, but do not produce enough DNA for testing to complete, we will contact you with options and pricing to resubmit new samples. If for any reason, you are not able to or willing to send in new samples for your case, no refunds will be issued since the lab has processed samples you submitted and worked to complete the case on your behalf.

    Should the lab be unable to complete testing due to information submitted to the lab with the samples (personal notes or statements regarding other possible relationships, etc.), no refunds will be issued. If you have any questions on what type of test to order, please contact us before ordering.

    If samples are not submitted within 90 days of case initiation, the case may be closed without refund. Additional fees may apply to re-open and process a closed case. After one year (12 months) from order date, the case cannot be reopened; a new test must be purchased.

    In certain circumstances we may request the purchaser or cardholder to provide a valid ID to verify he/she authorized the use of their card for the purchase. This is similar to, and nothing more than, presenting ID when making a purchase in person. If ID has been requested on your order, although your case may move along and testing complete, test results will not be released until the verification has been completed.

    No refunds will be issued if any or all samples for a case have been received in lab, or after any testing begins.

    Any refunds or partial refunds are at the discretion of PaternityUSA.com. No refunds will be made for cases or orders over 30 days old. No refunds for internet specials, sales or cases to which any discount has been applied.

    All returned checks will be electronically redeposited without further notice and declined credit or debit cards may be reprocessed.  By paying for your DNA test kit by check, it is understood that you agree to these terms.

    By purchasing a DNA test from PaternityUSA.com either through our online shopping cart, or over the phone, you are agreeing to these terms of sale.

    Non-compliant and non-viable (insufficient for testing) DNA Test Samples:

    It is very important that the samples be received by the testing laboratory in the specified time frame. It is important to comply to the allotted DNA or paternity testing time frame.  Failure to comply will result in additional costs associated with subsequent sampling or testing.

    It’s important to us you receive the answers you need. In the event that your DNA testing samples do not meet the stated requirements, we will attempt to contact you via telephone or email.  If we get a hold of you, we will give you the option to proceed with non-compliant samples at your risk, or to purchase a second DNA or paternity test kit and repeat the sample collection. If we are unable to contact you, your case will be put on hold. If there is no response within the previously specified case activity time frame (90-180 days), your case will be closed.

    If samples are received for your case and processed by the lab, but found to not produce enough DNA to complete the test, we will attempt to contact you with options to send in new samples. If you are not able to send in new samples. or choose not to, no refunds will be issued since the samples you sent were processed on your behalf.

    Following fees applied based on case situation:

    • Re sample/Retest: $30 – $60 per DNA or paternity test kit shipment plus per person fees
    • Proceed with Non-compliant Samples (or if we cannot reach you prior to test): $85 – $125 to re-sample and retest
    • Additional fees may be included for legal cases, international shipments, or DNA tests involving more than three participants

Both parties expressly waive a trial by jury.

    MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and PaternityUSA.com with respect to this Web site. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and PaternityUSA.com with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by PaternityUSA.com.
